Welcome to Collapsing Wave. These Terms of Service ("Terms") govern your use of the Collapsing Wave mobile application and related services (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorised use of your account.

3. The Service

Collapsing Wave is a language learning platform that provides audio-based educational content. The Service includes:

• Access to language learning publications and chapters
• Audio content for listening and reading practice
• AI-assisted learning features
• An AI Tutor for interactive language practice, conversation, pronunciation feedback, and grammar assistance
• Interactive language quizzes to test and reinforce your learning
• Content creation tools for publishers

4. Subscriptions, Payments, and Advertising

a) The Service offers both free (Basic) and paid (Premium) tiers.

b) The Basic (free) tier includes advertisements served by Google AdMob. Premium subscribers do not see advertisements.

c) Premium subscriptions are processed through in-app purchases via the Apple App Store or Google Play Store.

d) Payment terms, renewal, and cancellation are governed by the respective app store's policies.

e) Subscription prices may change. We will provide reasonable notice of any price changes.

f) You may cancel your subscription at any time through the app store where you purchased it.

g) Refunds are subject to the policies of the Apple App Store or Google Play Store.

5. Content and Intellectual Property

a) All content provided through the Service, including text, audio, images, and software, is owned by us or our content creators and is protected by intellectual property laws.

b) You are granted a limited, non-exclusive, non-transferable licence to access and use the content for personal, non-commercial educational purposes only.

c) You may not copy, distribute, modify, publicly display, or create derivative works from any content without prior written permission.

d) Downloaded content is for offline personal use only and remains subject to these Terms.

6. User-Generated and Creator Content

a) Content creators retain ownership of their original content published through the Service.

b) By publishing content on the Service, creators grant us a worldwide, non-exclusive licence to host, distribute, and display their content through the Service.

c) Creators are responsible for ensuring their content does not infringe on third-party intellectual property rights.

d) We reserve the right to remove any content that violates these Terms.

7. AI Tutor and AI-Generated Content

a) The Service includes an AI Tutor feature that uses artificial intelligence to provide interactive language tutoring, including conversation practice, pronunciation feedback, vocabulary review, and grammar assistance.

b) The AI Tutor processes your text input and, for pronunciation features, your voice recordings to provide personalised language learning responses.

c) AI Tutor responses are generated using a combination of self-hosted AI services and third-party AI providers who process data on our behalf. Conversation responses are generated by a language model operated by DeepInfra, Inc.; voice recordings used for pronunciation features are transcribed by Mistral AI. Details of this processing are set out in our Privacy Policy.

d) The AI Tutor is subject to daily usage limits. Basic (free) users receive a limited daily allowance; Premium users receive a higher allocation. These limits may be adjusted at any time.

e) The AI Tutor service may be temporarily unavailable during maintenance periods. Users will be notified of planned downtime through the Service.

f) Text-to-speech audio for AI Tutor responses is available to Premium users only and is generated on demand by a combination of self-hosted speech synthesis and third-party speech providers (currently Mistral AI and Fish Audio), depending on the language.

g) While we strive for accuracy, AI-generated content may contain errors. The AI Tutor is an educational aid and should not be relied upon as the sole source of language instruction. We do not guarantee the accuracy of AI-generated content.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Share your account credentials with others
• Attempt to circumvent payment or subscription mechanisms
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems to access the Service without permission
• Upload content that is offensive, harmful, or infringes on the rights of others
• Interfere with or disrupt the Service or its infrastructure

9. Privacy and Data Protection

a) Your use of the Service is governed by our Privacy Policy, which details how we collect, use, store, and protect your personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR).

b) By creating an account, you acknowledge that you have read and understood our Privacy Policy.

c) You have the right to access, rectify, erase, restrict, and port your personal data, as well as the right to object to certain processing. These rights are detailed in our Privacy Policy.

d) You may exercise your data protection rights at any time by contacting us through the Service or by deleting your account.

10. Disclaimers

a) THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

b) We do not guarantee that the Service will be uninterrupted, error-free, or secure.

c) The Service is an educational tool and does not guarantee specific learning outcomes.

d) We are not responsible for the accuracy of content provided by third-party creators.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Termination

a) You may delete your account at any time through the Service.

b) We may suspend or terminate your account if you violate these Terms.

c) Upon termination, your right to use the Service ceases immediately.

d) Active subscriptions should be cancelled through the respective app store before account deletion.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the Service or via email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by applicable law in the jurisdiction where the Service operator is established. Any disputes shall be resolved through the appropriate legal channels in that jurisdiction.
